NRI Power of Attorney for Property in Telangana: Drafting, Attestation and Registration
How NRIs and OCIs draft, sign, attest or apostille, stamp and register a power of attorney for buying, selling or taking a loan on Telangana property, what the SRO checks on the day, and how to revoke it safely.

- Use a specific POA for each transaction; a general POA gives far more power than most NRIs intend
- Sign before the Indian consulate, or before a notary with an apostille in Hague Convention countries such as the US, UK and Australia
- A POA signed abroad must be stamped (adjudicated) within three months of arriving in India
- Sale POAs should route proceeds only to your own NRO account and set price limits
- A POA never transfers ownership; only a registered sale deed does
| What | Indicative range | Note |
|---|---|---|
| Drafting by Hyderabad advocate | ₹5,000 – ₹20,000 | indicative, Oct 2026 |
| Consular attestation or notary plus apostille abroad | Modest official fees; varies by country | check your mission or state authority |
| Stamp duty, purchase-specific POA or POA to family member | Fixed duty | verify current amount at registration office |
| Stamp duty, POA to sell given to non-family attorney | Ad valorem on market value | verify; depends on wording |
| Time from first draft to usable POA in Hyderabad | 2 – 5 weeks | typical |
Ranges reflect recent transactions and advisor observation as of 2026-10. Always verify against the sub-registrar market value and the specific parcel.
An NRI power of attorney for property is the document that lets someone in India sign, present and register a property transaction on your behalf while you stay in Dubai, Dallas or Melbourne. Done well, it saves you two flights and weeks of leave. Done badly, it gets rejected at the Sub-Registrar's counter on the morning of registration, or worse, gives a relative far more power over your assets than you intended. This guide explains how NRIs and OCI cardholders should draft, sign, attest, adjudicate and use a power of attorney for buying, selling or managing property in Telangana, as of October 2026.
Who this guide is for
This guide is for NRIs and OCI cardholders who are buying a flat, villa or approved plot in Hyderabad, selling an inherited or self-acquired property in Telangana, or taking a home loan, and who cannot be physically present for every step. It is also for the parents, siblings and friends in Hyderabad who will act as attorney and want to know what the registering officer will ask of them.
What a power of attorney is, and why the details matter
A power of attorney (POA) is a written authority by which one person, the principal, appoints another, the attorney or agent, to act on the principal's behalf. In property matters it lets the attorney sign agreements and deeds, appear before the Sub-Registrar or Tahsildar, pay charges, apply for mutation and deal with banks, builders and authorities.
Three legal points shape everything that follows:
- A POA is not a transfer of ownership. The Supreme Court held in 2011, in the Suraj Lamp case, that sales through a general power of attorney, agreement of sale and will do not convey title. Ownership passes only through a registered conveyance such as a sale deed. A POA is a tool to execute that deed, nothing more.
- The attorney can only do what the document says. Registering officers read POAs literally. If the document authorises the attorney to "purchase" but not to "present for registration" or "admit execution", the SRO can refuse the deed.
- A POA executed abroad has extra formalities. It must be properly authenticated where you sign it, and once it arrives in India it must be stamped (adjudicated) within the time allowed under the stamp law before it can be acted upon.
Specific versus general power of attorney
The first drafting choice is scope. Our strong preference for NRI clients is a specific POA for each transaction.
| Feature | Specific (special) POA | General POA |
|---|---|---|
| Scope | One defined transaction or property, for example the purchase of a named flat | Broad powers over many matters or all properties |
| Typical use | Buying a flat, selling a named plot, signing a home loan, collecting a refund | Long-term management of several properties and accounts |
| Risk of misuse | Low; attorney cannot stray beyond the named deal | High; attorney can sell, mortgage or lease within its terms |
| Acceptance by SRO and banks | Easier, because powers are explicit | Sometimes questioned if vague; banks often insist on their own format |
| Stamp duty in Telangana | Usually a modest fixed duty, depending on the article applicable | Depends on powers; a GPA to sell given to a non-family attorney can attract ad valorem duty |
| Our advice | Default choice for NRIs | Only for trusted family, with clear limits and a sunset date |
A specific POA for a purchase should identify the property by survey number, plot or flat number, project name, village, mandal and district, and describe each act the attorney may perform. A specific POA for a sale should also state the minimum consideration or require written confirmation from you of the final price, and specify that the sale proceeds must be paid into your own NRO account, not the attorney's.
Who can act as your attorney
Legally, any adult of sound mind can be appointed. In practice, choose someone who:
- Lives in or near Hyderabad and can attend the SRO or Tahsildar office, the bank and the builder's office at short notice.
- Holds a PAN card and Aadhaar, because the registration system authenticates parties and witnesses biometrically and records PAN details for high-value transactions.
- Has no conflicting interest in the property, such as being the builder's agent or a co-heir who disputes the sale.
- You trust with money. Even a tightly drafted POA requires trust, because the attorney will handle documents and payments.
Close relatives are the most common choice, and in Telangana a POA in favour of specified family members is typically charged a lower stamp duty than one in favour of an outsider. You can appoint two attorneys to act jointly, which reduces misuse risk but means both must attend every step, or severally, which is more convenient but offers less protection. Avoid appointing your advisor, broker or the builder as attorney for a sale; it creates a conflict of interest.
How it works: signing abroad, attestation and apostille
How you authenticate the POA depends on the country where you sign it. The Indian authorities will accept either of two routes.
Route 1: Indian embassy or consulate attestation
You sign the POA in the presence of a consular officer at the Indian embassy or consulate (or its authorised outsourced service centre, where the mission uses one). The officer attests your signature and identity. Book an appointment, carry your passport and visa or residence permit, the POA printed on plain paper as per the mission's requirements, passport photographs and copies of the attorney's identity documents. Some missions require the document to be signed in front of the officer, so do not sign in advance. This route works in every country and is the usual route in the Gulf.
Route 2: Notarisation and apostille
If you live in a country that is party to the Hague Apostille Convention, such as the United States, the United Kingdom, Australia, Canada, Singapore and most of Europe, you can sign before a local notary public and then obtain an apostille from that country's designated authority (in the US, the Secretary of State of the relevant state; in the UK, the Legalisation Office of the Foreign, Commonwealth and Development Office). India is a member of the Convention, so an apostilled document does not need further consular attestation. Check that the notary's certificate clearly identifies you and the document.
Which route is faster depends on your city. In the US, notarisation plus state apostille can take a few days to a few weeks depending on the state. Consular appointments in busy cities can take longer. Ask us before choosing; we see current turnaround times from clients every month.
Photographs, fingerprints and identity
Telangana registering officers commonly expect the POA to carry passport photographs of the principal, ideally with your signature across them, and copies of your passport and the attorney's identity proof attached. Some offices ask for the principal's thumb impression on the document. Including these at the drafting stage avoids a second round of attestation.
After it arrives in India: adjudication and stamp duty
A power of attorney executed outside India is not stamped at the time of signing. Under the stamp law as it applies in Telangana, an instrument executed abroad must be stamped within three months of its first receipt in India. In practice this is done by presenting the original POA to the District Registrar or the Collector of Stamps (through the jurisdictional registration office) for adjudication, paying the duty assessed and getting the endorsement on the document.
Stamp duty on a POA in Telangana depends on what it authorises and to whom:
- A POA authorising acts such as presenting documents, admitting execution, or purchasing a specific property usually attracts a modest fixed duty.
- A POA authorising the sale of immovable property in favour of a specified close family member (spouse, parents, children, siblings) typically attracts a fixed duty.
- A POA authorising sale in favour of someone outside the family, or one coupled with consideration or interest, is usually charged ad valorem duty on the market value, and some such POAs are treated close to a conveyance for duty purposes.
Rates and classifications change and depend on exact wording, so we confirm the duty with the registering office before the original travels. Missing the three-month window means penalty on adjudication, so courier the original promptly and keep the airway bill to show the date of receipt.
Registration of the POA itself
Whether a POA must be registered depends on its content. A POA that only authorises the attorney to present a document for registration does not by itself need registration, but a POA authorising the sale of immovable property is, in practice, registered or deposited in Telangana and SROs check the registration and validity of POAs used in sale deeds. Registering a sale POA at the SRO creates a public record, makes verification easy for buyers and banks, and helps later if you revoke it. Our recommendation for any POA that authorises a sale is to register it in the SRO jurisdiction where the property lies, after adjudication. The registration department portal at registration.telangana.gov.in lists the procedures and allows slot booking.
Drafting checklist: clauses a Telangana property POA should contain
Every transaction is different, but a POA that will be used at a Telangana registration office should normally cover the following. Use it to review a draft before you book your consular or notary appointment.
- Full particulars of the principal. Name as in the passport, father's or spouse's name, age, current overseas address, passport number, OCI card number where applicable, and PAN.
- Full particulars of the attorney. Name, relationship, address in India, Aadhaar and PAN, with a specimen signature and photograph.
- Schedule of property. Survey number, plot or flat number, extent in sq yd, sq ft or acres and guntas, village, mandal, district, boundaries, and for apartments the project name, block, floor and undivided share of land.
- Enumerated powers. Each act listed separately: signing and registering the agreement of sale and sale deed, presenting documents and admitting execution, paying stamp duty and fees, applying for encumbrance certificates and certified copies, filing mutation and property tax changes, dealing with the builder, society, electricity and water boards.
- Money clauses. For a purchase, from which account payments will be made; for a sale, that all consideration is paid only to the principal's named NRO account, and whether the attorney may sign Form 15CA-related papers or TDS correspondence.
- Limits. No power to sub-delegate, to mortgage beyond a stated loan, or to sell to the attorney or their relatives, unless you specifically want that.
- Duration. A sunset date or automatic expiry on completion of the transaction.
- Ratification. A clause ratifying acts lawfully done under the POA, which registering officers expect to see.
Joint owners must each sign, or each execute a separate POA. If you hold an OCI card, describe yourself accurately; a foreign passport holder signing as an "Indian citizen" is an avoidable problem. The document itself is usually printed on plain paper abroad; stamp duty is paid after arrival through adjudication, not by buying Indian stamp paper overseas. If you are signing in a country where English is not the official language, ask the notary for an English certificate or have a certified translation attached, because the registering officer must be able to read the authentication.
Step-by-step: from draft to registered deed, with timelines and costs
| Step | Who does it | Typical time | Indicative cost (verify) |
|---|---|---|---|
| 1. Draft the POA to suit the transaction and the SRO's expectations | Advocate in Hyderabad, with your instructions | 2–5 days | ₹5,000 – ₹20,000 |
| 2. Review by bank or builder if a loan or allotment is involved | Lender's legal team | 3–7 days | Usually nil |
| 3. Sign before consular officer, or notary plus apostille | You, abroad | 1 day to 3 weeks depending on city | Consular fees or notary plus apostille fees, typically modest |
| 4. Courier original to India | You | 3–7 days | Courier charges |
| 5. Adjudication and stamp duty, within 3 months of receipt | Attorney with advocate | 1–10 working days | Fixed duty or ad valorem, depending on powers and attorney |
| 6. Registration of POA at SRO, where required or advised | Attorney | 1 day after slot | Registration fee as per schedule |
| 7. Execution and registration of the sale deed or agreement | Attorney on your behalf | 1 day after slot | About 7.5% of market value for sale deeds; verify |
| 8. Mutation, khata and utility transfers | Attorney | 1–6 weeks | Nominal official fees |
Plan backwards from the registration date. For a purchase with a builder's deadline, start drafting at least six weeks ahead.
What the SRO typically checks on the day
When an attorney presents a sale deed in Telangana, the registering officer will usually examine:
- The original POA, its adjudication endorsement and, where applicable, its registration details.
- That the powers cover every act being performed: executing the deed, presenting it, admitting execution, receiving consideration where relevant.
- That the property described in the POA matches the deed, including survey number, extent and boundaries.
- A recent declaration or affidavit that the principal is alive and that the POA has not been revoked, sometimes supported by a recent communication or life certificate from the principal. Some offices are strict about how recent this must be.
- The attorney's identity, biometrics and PAN, and the principal's PAN.
Having a scanned copy of everything checked by our team or your advocate a week before the slot is the single best way to avoid a wasted day.
POAs for home loans, sales and inherited land
Home loans
Lenders usually insist on a POA in their own format, authorising the attorney to sign the loan agreement, deposit title deeds and create the mortgage, and deal with disbursement. Sign the bank's format at the same consular visit as your purchase POA to save a trip. Our guide to NRI home loans covers the rest of the loan process.
Selling a property
For a sale, the POA should restrict the attorney to a named buyer or a minimum price, require proceeds to be paid into your NRO account, and authorise the attorney to sign TDS-related forms. Remember that the buyer must deduct TDS under Section 195; see our guide on TDS when buying from an NRI seller. After the sale, the steps for moving money abroad are in our repatriation guide.
Inherited agricultural land
NRIs cannot buy agricultural land in India and cannot receive it as a gift, but they can inherit it and sell it to a resident Indian. Sales of agricultural land register at the mandal Tahsildar office under the Dharani / Bhu Bharati system, and the Tahsildar will want the same quality of POA as an SRO. See NRI agricultural land rules in Telangana.
Worked example: a Houston couple buying a Kokapet flat
Ravi and Swathi, US citizens holding OCI cards, booked a ₹1.6 crore apartment near Kokapet in August 2026 and wanted Ravi's brother in Hyderabad to complete the agreement, loan and sale deed.
- Week 1: Our advocate drafted a specific POA naming the flat, tower, project, survey numbers and village, authorising the brother to sign the agreement of sale, the sale deed, all registration formalities, payment of stamp duty and the 1% TDS (the builder being a resident seller), and the bank's loan documents through a separate bank-format POA.
- Week 2: Both signed before a Texas notary; the documents were apostilled by the Texas Secretary of State. Cost: modest notary and apostille fees plus courier.
- Week 3: Originals reached Hyderabad. The brother, with our advocate, presented them for adjudication; a fixed duty was assessed because the attorney was a family member and the POA was purchase-specific.
- Week 5: Agreement of sale registered; loan sanctioned. Week 9: Sale deed registered at the jurisdictional SRO, with a fresh signed declaration from Ravi and Swathi confirming the POA was subsisting.
Total elapsed time from first draft to sale deed: about nine weeks. Nobody flew.
Revoking a power of attorney
You can revoke a POA at any time unless it is coupled with an interest (for example, a POA given to a developer under a development agreement, which is generally irrevocable while the interest subsists). To revoke:
- Execute a deed of revocation, authenticated abroad in the same way as the original POA.
- If the original POA was registered, register the revocation at the same SRO so that it appears in records searched by future buyers.
- Serve written notice on the attorney and on anyone who may deal with them: the builder, the bank, the society, tenants. Keep proof of delivery.
- Recover the original POA where possible.
A POA also ends automatically on the death or insolvency of the principal, or on completion of the specific transaction. Third parties who deal with the attorney in good faith without notice of revocation may be protected, which is why notice matters.
Mistakes we see in practice (and the fix)
- Vague powers. "To look after my property" does not authorise a sale or registration. Fix: list each act explicitly.
- Wrong property description. A mismatch of one digit in a survey or flat number can stop registration. Fix: copy descriptions from the title documents and builder allotment letter, and have them checked.
- Missing the three-month stamping window. Fix: courier promptly and book adjudication on arrival.
- General POA to a distant relative for a sale. Fix: use a specific POA with price limits and proceeds routed to your NRO account.
- Forgetting the bank's own format. Fix: get the lender's POA format before your consular appointment.
- No proof the principal is alive. Fix: send a fresh signed declaration and passport copy shortly before the registration date.
- Using a POA as a substitute for a sale deed. Fix: never buy property "on GPA"; insist on a registered sale deed from the owner or their attorney.
- Not revoking after the deal. Fix: let specific POAs expire with the transaction, and formally revoke general POAs you no longer need.
How NRR Estates handles POAs for NRI clients
Our NRI desk coordinates the whole POA cycle with an empanelled Hyderabad advocate, with fees disclosed upfront. We take instructions over a call, prepare a draft that matches the property documents and the registering office's current practice, share the bank's format where a loan is involved, guide you through consular or apostille signing in your city, track the courier, handle adjudication and registration with your attorney, and attend the sale deed registration. After the deal, we help with mutation and, if you ask, with revocation. For the wider picture of buying from abroad, start with our NRI investment guide for Telangana and NRI guide to villas and apartments in Hyderabad. For registration charges, see our stamp duty and registration guide.
We are not a substitute for legal advice on complex family situations such as disputed inheritance; in those cases we bring in an advocate, and for tax questions a chartered accountant.
NRI power of attorney: frequently asked questions
Can an NRI buy or sell property in Telangana without travelling to India?
Yes. An NRI or OCI cardholder can appoint an attorney in India through a properly drafted power of attorney, signed before the Indian consulate or before a notary with an apostille, and stamped in India within three months of arrival. The attorney can then sign and register the agreement and sale deed, pay charges and handle mutation. You will still need to arrange funds from your NRE, NRO or FCNR account, provide PAN details, and sometimes send a recent declaration that the POA is still in force.
Should I give a general or specific power of attorney?
For most NRIs, a specific power of attorney is safer. It names the property and lists the exact acts the attorney may perform, such as signing and registering the sale deed for a particular flat. Registering officers and banks accept it more readily, and it cannot be used to deal with your other assets. A general power of attorney gives broad authority over many properties or matters and carries much higher misuse risk. Use one only for a trusted family member, with clear limits and an expiry date.
Do I need an apostille or consulate attestation for a POA from the USA or UK?
Either works. The US and UK are parties to the Hague Apostille Convention, as is India, so you can sign before a local notary and obtain an apostille from the designated authority, such as a US state's Secretary of State or the UK's Legalisation Office. Alternatively, sign before a consular officer at the Indian embassy or consulate. Choose whichever is faster in your city. In countries outside the Convention, consular attestation is the usual route. Do not sign before the officer or notary asks you to.
What is adjudication of a power of attorney and is it compulsory?
Adjudication is the process by which the stamp authority in India assesses and collects stamp duty on a document executed abroad. A POA signed outside India must be stamped within three months of its first receipt in India before it can be acted upon. In Telangana this is done through the District Registrar or Collector of Stamps via the registration office. The duty depends on the powers granted and the relationship of the attorney. Missing the deadline attracts a penalty, so courier the original promptly and keep proof of arrival.
Who can be my attorney for a property transaction in Hyderabad?
Any adult of sound mind can be appointed, but choose someone in or near Hyderabad who can attend the registration office and bank, has PAN and Aadhaar for biometric authentication, and has no conflicting interest in the property. Close family members are most common and in Telangana usually attract lower stamp duty on the POA. Avoid appointing the builder, a broker or your advisor as attorney for a sale. You can appoint two attorneys to act jointly for added protection, at the cost of convenience.
Does a power of attorney need to be registered in Telangana?
A POA that only authorises presentation of a document for registration does not by itself require registration. A POA authorising the sale of immovable property is, in practice, registered or deposited in Telangana, and SROs check its registration and validity when an attorney executes a sale deed. Registering it in the SRO jurisdiction where the property lies creates a public record, reassures buyers and banks, and makes later revocation effective. We recommend registering any POA that authorises a sale after it has been adjudicated.
How do I revoke a power of attorney given for property in India?
Execute a deed of revocation, authenticated abroad the same way as the original POA. If the original was registered, register the revocation at the same SRO so it appears in records searched by buyers and banks. Send written notice to the attorney and to anyone likely to deal with them, such as the builder, bank, association or tenants, and keep proof of delivery. Recover the original POA if possible. A POA coupled with an interest, such as one given under a development agreement, is generally irrevocable while that interest subsists.
Can my attorney receive the sale money on my behalf?
It is possible but not advisable. We draft sale POAs so that all consideration is paid by the buyer directly into the principal's own NRO account, with TDS deducted by the buyer under Section 195 and the certificate issued in the principal's name. This protects you from misuse, creates a clean audit trail for your chartered accountant, and makes repatriation easier, because banks ask for proof that sale proceeds came from the buyer to your account. Avoid any arrangement where proceeds pass through the attorney's personal account.
